Notar

Notar, mit öffentlicher Autorität ausgerüstete Person, welche über das, was an Rechtsgeschäften vor ihr u. 2 Zeugen vorgeht, vollständigen Beweis gibt. Man pflegt daher solenne Verträge. Testamente u.s.w. unter ihrer Mitwirkung zu errichten, um die erforderlichen Formen, welche der N. als Rechtskundiger kennen soll, nicht zu verfehlen. In einigen Ländern ist sogar für Testamente u. dgl. die Mitwirkung u. Mitunterzeichnung des N.s als gesetzliche Form vorgeschrieben. In andern ist den N.en auch die Leitung des Hypothekarwesens (Grundbücher, Ausfertigung des Pfandbriefs) übergebe n. Die N. iatsberechtigung ist in der Regel durch Examen, Patent und Caution bedingt. Das Nähere bestimmen die gesetzlichen N. iatsordnungen.
