Adoption, Annahme an Kindesstatt. Im deutschen Recht unbekannt, ebenso im größeren Theile der Schweiz. Dagegen durchs römische Recht, soweit es. Geltung erlangte, eingeführt. Der Adoptirte wird Descendent, d.h. Kind oder Enkel; an Brudersstelle u.s.w. gibt es keine Adoption. Erfolgt die Adoption durch einen Ascendenten, so heißt sie plena; durch eine Drittperson minus plena. Bei jener tritt das Adoptivkind in die Familiengewalt des Adoptivvaters, erlangt dessen Namen und Stand (sofern er höher ist als sein eigener bisheriger), wird Intestaterbe desselben und seiner Agnaten, tritt aus allen Agnationsverhältnissen der natürlichen Familie aus, erwirbt an seinem Vermögen dem Adoptivvater Nießbrauch und Intestaterbrecht. Die A. m. plena erstellt bloß zu Gunsten des Kindes ein Intestaterbrecht. Zur Adoption eines sui juris (Mündigen) ist die landesherrl. Einwilligung erforderlich und heißt im engern Sinn Arrogation. Zur Adoption eines noch in potestate bedarf es vor Gericht der Zustimmung des A.vaters, des A.kindes und dessen, welcher es bisher in seiner Gewalt hatte. Der A.vater muß wenigstens 60 Jahre alt sein, zur Zeit der A. ohne eigene Descendenten, an sich zeugungsfähig, auch mit Rücksicht auf das A.kind, deßhalb 18 Jahre älter als dieses. Der Vormund kann den Mündel nicht adoptiren, der Arme nicht den Reichen. Frauen können nur ausnahmsweise mit Bewilligung des Landesherrn adoptiren, zum Troste für eigene verstorbene Kinder. So in der Hauptsache auch in Oesterreich, Preußen und Sachsen.
